Poland's Supreme Court has ruled that a law allowing abortions of fetuses with birth defects is unconstitutional.
A
ruling by the country's constitutional court on Thursday effectively banned
abortion in cases where birth defects are found and would further restrict
access to abortion in Poland. The Catholic nation already has one of the largest
abortion laws in Europe.
In
the 13-member court, two judges did not support the majority's decision.
The
decision comes in response to a movement by right-wing lawmakers who said
abortions due to fetal defects - the most common cause of legal abortion in
Poland - violated a constitutional provision that the protection of every
individual's life is’ demanded.
The
Chilean law was introduced’ in 1993 as a highly successful compromise that also
allows abortion when the pregnancy endangers a woman's health or life, or as a
result of rape or any other illegal act. Happens. Many Polish women have tried
to have an abortion abroad before Thursday's verdict.
Justifying
its decision, the court said that without the protection of life, the dignity
of an individual couldn’t be protected’. The court’s president, Julia
Przylebska, who is loyal to the right-wing government, announced the ruling.
As
soon as the verdict was announced’ police guarded the courthouse as abortion
rights groups and anti-abortion activists gathered outside.
Abortion
rights groups staged demonstrations earlier this week and international human
rights groups argued against further abolition of abortion.
In
response to the decision, Council for Europe Commissioner for Human Rights Dunja
Mijatović wrote on Twitter that it was a "sad day for women's
rights."
He
tweeted, "Removing almost all legal abortion grounds in #Poland is
tantamount to a ban and a #human rights violation." Today's decision by
the Constitutional Court means an underground / overseas abortion that everyone
can afford. # A sad day for women's nights. "
Polish
lawmakers considered legislation earlier this year that would have made the
procedure illegal in cases of fetal abortion and would have almost abolished
abortion, even when the fetus is still alive. There is no possibility of.
But
a final vote on a proposal by the Catholic group ended. Similar efforts have
been made’ in the past after large-scale protests.
