ISLAMABAD: The Islamabad Accountability Court (IAC) has ordered the auction of the confiscated properties of former prime minister and PML-N supremo Nawaz Sharif in the Tosha Khana reference.
Accountability court judge Syed Asghar Ali heard the case and accepted the NAB's request for auction of the former prime minister's properties and ordered that wherever Nawaz Sharif's properties were located, the relevant provincial government could auction them. The court directed the deputy commissioners of Lahore and Sheikhupura to submit a report on the auction within 60 days.
The court also directed the concerned authorities to deposit the money in the national treasury after the auction of Nawaz Sharif's properties. The court also ordered to auction of Nawaz Sharif's vehicles within 30 days. The court said police assistance should be sought to stop the vehicles before they are sold.
The court also directed the authorities to transfer all funds from Nawaz Sharif's bank accounts to the national exchequer. The court said only those properties against which there was no objection could not be auctioned. The court had earlier accepted the pleas of former President Asif Ali Zardari and former Prime Minister Yousuf Raza Gilani for exemption from attendance. The court later adjourned the case till April 28. On Thursday, Judge Syed Asghar Ali said the court would act on the NAB's request to settle Nawaz Sharif's illegal claims.
The petition was filed by NAB Deputy Prosecutor General Sardar Muzaffar Khan Abbasi. Citing the order of the accountability court in which Nawaz Sharif was allegedly found guilty in the Tosha Khana reference, Muzaffar Abbasi stated that despite the passage of six months, the former prime minister did not surrender before the court.
It is to be noted that NAB had submitted a report before the accountability court in which it was said that Nawaz Sharif owns shares in four registered companies and operates eight accounts including three foreign currency accounts. The former prime minister also owns a Land Cruiser, two Mercedes cars and two tractors. His dependents also have properties in Lahore, Sheikhupura, Murree and Abbottabad.
Maryam Nawaz had already challenged the attachment of Sharif family properties in Murree and Changla Gali in connection with the Toshikhana reference as her father Nawaz Sharif had absconded.
Maryam Nawaz filed a petition in the Tosha Khana case against the attachment of House No. 24-A & B, III, Hall Road, Murree, located at Changla Gali, Abbottabad.
He said in the petition that both the houses are owned by his late mother Kulsoom Nawaz. He said that both the houses had already been purchased in excess of the period mentioned in the reference and after the death of the owner of the house under discussion, the ownership was transferred to the legal heirs as per the decision and order dated May 14, 2019. The joint property of the heirs is divided into properties.
According to the Toshakhana reference, Nawaz Sharif and Asif Ali Zardari got the vehicles from Toshakhana by paying only 15% of the price of luxury cars.
The NAB alleges that Yousuf Raza Gilani facilitated the allotment of vehicles to Asif Ali Zardari and Nawaz Sharif and illegally relaxed the procedure for approving and disposing of gifts under the 2007 Cabinet Division Memorandum. The Islamabad Accountability Court III had in May last year issued non-bailable warrants for non-participation in the court proceedings in reference to Nawaz Sharif and had also initiated proceedings to convict him.
